In this Privacy Policy, unless the context otherwise requires: "Kin Grid", "we", "us" and "our" means Kin Grid Pty Ltd, a company incorporated in Australia; "Personal Information" has the meaning given to it under the Privacy Act 1988 (Cth) and includes information or an opinion about an identified individual or an individual who is reasonably identifiable; "Services" means all digital products, platforms, dashboards, configuration outputs, and related services provided by Kin Grid; "you" and "your" means any individual who accesses or uses the Services or submits Personal Information to us.
2. Collection of Personal Information
We collect Personal Information only to the extent necessary for the proper provision of our Services. The categories of Personal Information we may collect include, but are not limited to:
Identification information, including your name and email address, submitted via our intake forms;
Device and technical information, including IP addresses, browser type, and usage data collected automatically via cookies and similar tracking technologies;
Household configuration preferences and layout choices you provide during the onboarding process;
Communications you direct to us, including support enquiries and feedback.
We do not knowingly collect Personal Information from individuals under the age of 13. If you believe a minor has provided us with Personal Information, please contact us immediately at the address set out in Section 10.
3. Use of Personal Information
We use Personal Information collected from you for the following purposes:
To deliver, configure, and personalise the Services you have requested;
To send transactional communications, including setup packs, layout documentation, and support correspondence;
To send promotional or marketing communications where you have provided consent or where we are otherwise permitted to do so under applicable law;
To comply with our legal obligations under Australian law, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs);
To improve, develop, and maintain the quality of our Services;
To detect, investigate, and prevent fraudulent or unlawful activity.
4. Disclosure of Personal Information
We will not sell, rent, or trade your Personal Information to third parties. We may disclose Personal Information to the following categories of recipients where necessary:
Third-party service providers engaged to assist in the operation of our Services, including email delivery platforms, hosting providers, and payment processors, each bound by confidentiality obligations no less stringent than those set out herein;
Professional advisers, including lawyers, accountants, and auditors, where required for the conduct of our business;
Regulatory authorities, law enforcement agencies, or courts of competent jurisdiction where required or authorised by law.
Where Personal Information is disclosed to overseas recipients, we take reasonable steps to ensure that the recipient handles the information in a manner consistent with the APPs.
5. Storage and Security
We take reasonable technical and organisational steps to protect your Personal Information from misuse, interference, loss, unauthorised access, modification, or disclosure. 1. Acceptance of Terms
By accessing or using the website, products, digital deliverables, or any other services offered by Kin Grid Pty Ltd ("Kin Grid", "we", "us"), you ("User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease use of the Services. Your continued use of any part of the Services constitutes acceptance of these Terms in their entirety.
2. Description of Services
Kin Grid provides digital family scheduling and household coordination systems, including but not limited to: custom calendar configuration blueprints, digital dashboard templates, onboarding documentation, and optional third-party physical display installation services coordinated through licensed trade partners ("Services"). The Services are provided on an as-is basis and are subject to change without prior notice.
3. Eligibility
You must be at least 18 years of age and possess the legal capacity to enter into a binding contract under the laws of your jurisdiction to access or use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements. We reserve the right to verify your eligibility at any time and to suspend or terminate your access if we reasonably determine that you do not meet these requirements.
4. Intellectual Property
All content, materials, layouts, templates, documentation, trademarks, trade names, and other intellectual property made available through the Services ("Kin Grid IP") are the exclusive property of Kin Grid or its licensors and are protected by the Copyright Act 1968 (Cth) and other applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Kin Grid IP solely for your personal, non-commercial household purposes. You must not reproduce, distribute, modify, create derivative works of, or otherwise exploit Kin Grid IP without our prior written consent.
5. User Obligations
In using the Services, you agree that you will not:
Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
Attempt to gain unauthorised access to any part of the Services or any system or network connected thereto;
Transmit any material that is defamatory, offensive, or otherwise objectionable;
Resell, sublicence, or commercially exploit any part of the Services or Kin Grid IP without express written authorisation;
Interfere with or disrupt the integrity or performance of the Services or any third-party data contained therein.
6. Payment and Refunds
Where applicable, fees for Services are payable in Australian dollars (AUD) inclusive of GST unless otherwise stated. All payments are processed through third-party payment providers and are subject to the terms of those providers. We operate a no-refund policy on digital deliverables once they have been accessed or downloaded, except where required by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). For physical installation services, cancellation policies and applicable fees will be communicated to you separately at the time of booking.
7. Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. To the fullest extent permitted by law, where our liability cannot be excluded, it is limited to the resupply of the Services or the payment of the cost of having the Services resupplied, at our election.
8. Limitation of Liability
Subject to Section 7, to the maximum extent permitted by applicable law, Kin Grid, its directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damages, including without limitation loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of or inability to use the Services, regardless of whether such loss was foreseeable or we had been advised of its possibility.
9. Third-Party Services
The Services may incorporate or link to third-party products, services, or websites. We do not endorse, control, or accept responsibility for any third-party content, products, or services. Physical wall installation services are performed by independent licensed trade contractors and Kin Grid accepts no liability for the acts or omissions of those contractors beyond our obligations under the Australian Consumer Law.
10. Termination
We reserve the right, in our sole discretion, to suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, third parties, or the general public. Upon termination, all licences granted to you under these Terms shall immediately cease.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia. In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved within 30 days of notice, either party may refer the matter to mediation before pursuing litigation.
12. Amendments
We reserve the right to modify these Terms at any time by posting the revised Terms on our website. Your continued use of the Services after the effective date of any amendment constitutes your unconditional acceptance of the revised Terms.
